Los Angeles County leaders approve funding for free eviction attorneys for renters, a first in Southern California

Los Angeles County Approves Plan for Free Attorneys for Low-Income Renters Facing Eviction

Los Angeles County’s Board of Supervisors has taken a groundbreaking step towards providing free legal representation to low-income renters facing eviction. The plan, known as the “Right To Counsel” program, was unanimously approved and is set to take effect on January 1, 2025, pending a final vote.

This initiative, the first of its kind in Southern California, aims to address the surge in eviction filings following the expiration of pandemic renter protections, which has resulted in thousands losing their homes. Supervisor Holly Mitchell, a key proponent of the program, emphasized the importance of ensuring that every Angeleno, regardless of income, has access to affordable legal services to protect their housing rights.

The program will specifically cater to renters in unincorporated parts of L.A. County, such as East Los Angeles and South L.A. neighborhoods. Eligibility will be based on income limits, with tenants needing to have a household income of 80% or less of the area’s median income.

While the initial funding for the program will come from federal pandemic relief money, future financing may be sourced from a proposed November ballot measure to raise sales tax for homelessness and housing programs. Advocates argue that providing legal aid to tenants can ultimately save money by reducing the burden on the county to pay for homeless services.

Landlord groups have expressed opposition to the plan, suggesting that funds would be better utilized in providing rental subsidies to struggling renters. Data from L.A. courtrooms reveals a stark disparity, with the majority of landlords having legal representation while most tenants lack access to attorneys in civil eviction proceedings.

Tenants who have represented themselves in court describe the experience as navigating an uneven playing field, highlighting the challenges of understanding complex court rules without legal assistance. The implementation of the Right To Counsel program in L.A. County would align with similar initiatives in cities like San Francisco, Philadelphia, and New York, where eviction filings have decreased and tenants connected with attorneys have a higher chance of retaining their housing.

As the county moves forward with this groundbreaking program, resources such as Stay Housed L.A. and legal aid organizations are available to assist tenants facing eviction. With the aim of leveling the playing field and ensuring housing stability for all residents, the Right To Counsel program represents a significant step towards upholding housing rights in Los Angeles County.
